
Our position on what should be done on State Project X241-0.00 02 - New River Parkway
- Raleigh and Summers County because of the incorrectly cited environmental
studies is as follows:
As the following conditions now exist:
- The National Environmental Protection Act Sec. 771.130 (2) mandates that a
Supplemental Environmental Impact Study must be done if new information or circumstances relevant to environmental concerns and bearing on the
proposed action or its impacts would result in significant environmental impacts not evaluated in the
EIS.
- In as much as at least four, if not more, "environmental studies" being cited in the New River
Parkway 1998 DEIS were not done on the proposed New River Parkway project or relative to that project and have been affirmed as not applicable to that
project by the very biologists cited in that DEIS.
- The state of West Virginia did not make the biologists aware that these
studies were being cited in order to study construction of the road.
Therefore the biologists could not and did not account for the impact of the
road in their studies.
- The West Virginia Department of Highways has acknowledged in writing that
they made a mistake in citing studies as being done for the road that were
in fact not related to the project.
The following things must take place:
- A Supplemental EIS be initiated immediately and all action on the project
be terminated until such environmental impact studies are done. Failure to
do is in violation of NEPA and will result in irreparable harm and a
substantial and adverse environmental impact to the New River and it's
aquatic life.
- The state must suspend any further activities which would have an adverse environmental impact to the New
River and it's aquatic life and that the WVDOH initiate a true and complete comparison of reasonable alternatives.
- A complete list of all environmental studies, including, subject, dates of
study, location of study must be made available to the public along with
information on how to obtain free written copies of such studies when
requested in writing.
